Hendrick wins appeal

Rick Hendrick must have the magic touch, because yesterday he won another NASCAR appeal ... something rival car owners just can’t seem to figure out how to do.
The issue: Kyle Busch’s engine-intake manifold for the Busch race at Kansas City three weeks ago. NASCAR didn’t like the way it looked, insisted that the team had “unapproved intake-manifold modifications to the plenum area,” and fined crew chief Michael Bumgarner $10,000.
Hendrick insisted that the particular manifold had already passed several other NASCAR inspections without question. The team noted that the intake-manifold rules were rather vague but pointed out the manifold did meet NASCAR’s current measuring gauges.
The appeals committee - Richard Gore, David Hall and standing chairman George Silbermann - unanimously rescinded the penalty.
Hendrick said: “Obviously we’re pleased with the decision. We appreciate the commission giving us the opportunity to present the facts and send a clear message about our performance at Kansas.
“The team prepared a race-winning car that met every rule in the book. It’s important that our fans, our sponsors and our competitors know that’s the case.”
